These Terms & Conditions (“Terms”) govern your use of the Maison Fidé website and any purchase from Fidé Beauty and Wellness LLC, doing business as Maison Fidé (“Maison Fidé,” “we,” “us,” or “our”). By accessing the website or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.
1. Eligibility and acceptable use
You must be able to form a binding contract in your jurisdiction to make a purchase. You may not use the Services for unlawful, fraudulent, abusive or harmful activity; interfere with security or operation; scrape or copy content without authorization; introduce malicious code; or violate another person’s rights.
2. Product information
We work to describe and display products accurately. Screens, lighting and natural production variations may affect how colors and materials appear. Fragrance perception and wear are subjective and vary by person, environment and application. Notes describe an olfactive impression and do not necessarily identify every material in the formula. Images may include props not included with purchase.
3. Orders and acceptance
An order confirmation acknowledges receipt; it does not guarantee acceptance. We may limit quantities or cancel an order before shipment for reasons including inventory errors, suspected fraud, pricing or listing errors, shipping restrictions or misuse of promotions. If we cancel after payment, we will refund the affected amount.
4. Prices, taxes and payment
Prices are shown in the currency selected by the store and may change without notice. Taxes, shipping, duties and other charges are shown where applicable. You authorize our payment providers to charge the payment method submitted. Currency conversion and issuer fees are controlled by your provider.
5. Shipping, title and delays
Shipping is governed by our Shipping & Delivery Policy. Delivery dates are estimates unless expressly guaranteed. If we cannot ship within an advertised timeframe, we will provide the notice and options required by applicable law.
6. Returns and refunds
Returns and refunds are governed by our Returns & Refunds Policy. Nothing in these Terms limits non-waivable consumer rights.
7. Samples, travel sizes and promotional credits
Samples and travel sizes are independent products. A credit toward a future purchase applies only when the offer is expressly displayed or issued in writing. Unless an offer states otherwise, codes are single-use, non-transferable, have no cash value, cannot be combined, expire on the stated date and cannot be applied retroactively. We may void a code obtained or used through error, abuse or fraud, subject to law.
8. Reviews and user content
If you submit a review, image, comment or other content, you confirm that you own it or have permission to share it and that it is accurate and lawful. You grant Maison Fidé a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, publish and display that content in connection with our business and marketing, subject to applicable law and any separate written terms. We may moderate content but are not obligated to publish it.
9. Intellectual property
The website and its content — including names, trademarks, logos, product names, copy, images, video, design and other materials — are owned by Maison Fidé or its licensors and protected by law. No right is granted except a limited, revocable right to use the website for personal, non-commercial purposes.
10. Third-party services
The Services may use or link to third-party services, including Shopify, payment providers and social platforms. Third-party terms and policies apply to their services. We are not responsible for third-party content or conduct except as required by law.
11. Disclaimers
To the fullest extent permitted by law, the Services and content are provided “as is” and “as available.” We do not warrant that the Services will be uninterrupted, error-free or suitable for every purpose. Fragrance and wellness content is general information and is not medical advice. Stop use and seek appropriate guidance if irritation or an adverse reaction occurs.
12. Limitation of liability
To the fullest extent permitted by law, Maison Fidé and its affiliates, officers, employees and providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits or data, arising from the Services. Our aggregate liability for a claim will not exceed the greater of the amount you paid for the product giving rise to the claim or $100. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold Maison Fidé harmless from third-party claims arising from your unlawful misuse of the Services, your violation of these Terms or your infringement of another party’s rights.
14. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Unless applicable law requires otherwise, disputes will be brought in the state or federal courts serving Collin County, Texas, and the parties consent to their jurisdiction. Counsel should confirm this provision before publication, especially if an arbitration clause or international sales are planned.
15. Changes and severability
We may update these Terms by posting a revised version with a new date. Changes apply prospectively unless law allows otherwise. If any provision is held unenforceable, the remaining provisions remain in effect.
16. Entire agreement and waiver
These Terms and incorporated policies are the agreement between you and Maison Fidé concerning the Services. A failure to enforce a provision is not a waiver.
